SAE vs Drewtech - A lesson for us all on standards

Directly related to the NMEA 2000 standards and access to GPL is the case of DrewTech vs the Society of Automotive Engineers (SAE).

Drewtech won the case to release stack code into the GPL based on SAE J1939-84. I've listed the link elsewhere as most Crusaders use the J1939 link.

More correctly, Drewtech won the case to release GPL-licenced source code without paying royalities to SAE.

SAE's action is typical of organizations trying to protect what they consider their intellectual property by using copyright.

If I photocopy someone else's document and try to hand it around as my own work then I am in breach of copyright.

If I take someone else's document and rewrite the gist of the document in my own words then I am not in breach of copyright, in fact I now own the copyright on the new document.

Drewtech in writing is own code, using the gist of the SAE's standard, is now the copyright owner of the code and can do what it likes with the code, it has nothing to do GPL-licencing. If they want to place it in the public domain they are free to do so.

Why SAE should think that they own the intellectual property in a standard is also doubtful. It is surely owned by ALL the people who contributed to the standard in the first place, starting in this case with Robert Bosch who invented the CAN protocol.

When I was equipping my pickup to tow a boat, many years ago, I did what any upstanding engineer would do: I looked up the SAE standard electrical connector for trailer applications, so I would be interchangeable with other trailers.

I found a plug/socket pair that met the spec and installed the socket on my truck, and put the plug on the trailer.

But I have never seen another one like it -- when I was at a huge RV and trailer place in the panhandle, mechanics were calling each other over to look at the odd connectors.

So much for SAE standards.

Fpmurphy is correct. Legally speaking without a decision any product based on J1939 would have royalty payments. Similarly Wireless internet equipment provider Buffalo is under the gun for CSIRO patents.

Doug, I am not surprised on that connector .... only economics and use sustain standards.
