Hey guys, as I have stated before I am selling my 1972 FB Express ($13,000). I had a buyer who was interested in November. We met at the boat, which is now dry docked. Talked for a couple hours and he says he will take it. He agrees to pay cash, which I give him a discount for. He has what looks like all the cash on him, but says he will give me $500 as a deposit and we will meet in two days for finalizing the rest of the transaction. Long story short, nothing has happened since. I have given him every opportunity to complete the deal, which he hasn't. We have talked several times and he said we would meet and we haven't. At this point my calls to him go unanswered. I go back up to the boat a couple weeks ago and he has been back on the boat. I told the marina to watch out for him and they have been very good about this.. Just a heads up to all you sellers out there.. The guy seemed sincere but .... I have since listed it with a broker. If I don't sell it it's going in the water in about 6 weeks.. Well, maybe six is a little optimistic.. So, I'll have two boats this year.. Sweet! ( But I could use the cash!)

Cheers!

Sean,

Looks like your $500 ahead I’d give him a call leave a message stating in definite term that he has X amount of days to complete the deal or he will forfeit the $500 & the boat will be put back on the market. It just that simple Think

Bet his wife found out. Only way to sell is, I get the cash, you get the boat. Lots of tire kickers and dreamers and BSer's out there. Keep the $500 and consider yourself lucky.--Ed

I already did that with the deadline... And the boat is back on the market.. Maybe I'll just rent it out for $200.00 per hour with a three hour minimum..Hmmmm..

This why whenever I am showing a boat it is understood that the deposit is non refundable, ( weeds out the fender kickers) Also the buyer buys fuel for sea trial, If they buy the boat I deduct the price of fuel off the selling price ( providing everything I have told them about the boat checks out ). I have never had a serious buyer object to any of these terms. Whistle

Did or did you not get the $500 deposit? The way I read your post, you did not.

I agree.. But who has $500.00 to blow like that? All he has to do is call me back and say, I changed my mind or I can't come up with the rest..

Peters probably right, I usually (on more exspensive items) write out a reciept (or print one on my computer) with the date, both parties name, item description and ID numbers, how long the buyer has to back down ect. on it, and both parties sign it, unfortunately the days of the handshake are long gone...JAM

It has been three weeks since I have heard from him, and I am the one that has been trying to get in touch! I leave messages and send texts.. I give up. Like I said I listed it with a good broker in our area.

You might want to send him a registered letter telling him that, because of his apparent default, you are listing the boat, but that until it sells (until someone else places a deposit) all he needs to do is show up with the bux and it's his. After all, you are trying to sell it. When I bought my current boat, I went thru hell trying to raise enough cash, even though it wasn't a lot. We think we're well off until we actually need $100 bills, then the stack is pretty short. I ended up taking money from my IRA to get over the top, then replacing it within the 60-day limit to avoid penalties.

I would Doug, except I don't have an address for him! All I have is his phone # and he doesn't return my calls. It sounds moronic now, but really he had money for the boat (cash w/him) and I fully expected he would be there in two days like we planned to finalize the transaction. Being a person who honors his word I wouldn't do that to someone.. AND I wouldn't want to lose $500.00! Live and learn.

Since he seems to be visiting your boat. secure a letter in a clear cover to the boat stating the other posters idea. Also leave a letter with the marina office if they see him to pass it on and for their own benefit too.
